Frequently Asked Questions
We know family law can feel overwhelming—and sometimes, just getting clear answers makes all the difference. Below you’ll find thoughtful responses to the questions we hear most often, designed to help you feel informed, prepared, and empowered as you move forward.

Am I responsible for my spouse’s credit card debt after divorce?
It depends—and this is where things can get tricky.
In North Carolina, debts are divided through equitable distribution, just like assets. That means the court looks at when the debt was incurred and whether it benefited the marriage.
- Marital debt (incurred during the marriage for joint benefit) is typically divided between spouses
- Separate debt (before marriage or not for the marriage’s benefit) usually stays with the person who incurred it
Here’s the important part: even if a divorce agreement says your spouse is responsible for a credit card, the creditor doesn’t care about your divorce order. If your name is still on the account, they can still come after you.
