Can alimony be modified if one spouse's income increases significantly?

It depends. In North Carolina, some alimony orders can be modified if there's been a substantial change in circumstances, but not every increase in income automatically qualifies.

The court may consider:

  • Whether the increase is significant and ongoing.
  • Whether the recipient's financial needs have changed.
  • Whether the paying spouse's ability to pay has changed.
  • The specific language of the alimony order or agreement.

It's also important to know that some separation agreements make alimony non-modifiable. If that's the case, the court may not have the authority to change the amount, even if circumstances have changed.
