Do I need an attorney if my spouse and I agree on everything?

Even in an amicable situation, having your own attorney review any agreement is worth it. North Carolina law doesn't allow one attorney to represent both spouses, even for a separation agreement you've already worked out together.

Here's why it still matters when things are friendly:

  • An attorney can spot gaps in the agreement that might cause problems years later, like what happens if one of you remarries or retires early.
  • Verbal or informal agreements aren't enforceable the way a properly drafted, signed separation agreement is.
  • Full financial disclosure protects both of you if circumstances change down the road.

Agreeing on everything now is a great starting point. Making sure it's documented correctly is what protects that agreement later.
