Is legal separation required before divorce in NC?
North Carolina doesn’t have a formal “legal separation” process like some states—but you do have to be separated for at least one year before you can file for an absolute divorce.
To be considered legally separated in North Carolina:
- You must live in separate residences
- At least one spouse must intend for the separation to be permanent
There’s no paperwork required to be separated, but many people choose to enter into a separation agreement during that year to address things like property division, custody, and support.
