What are the most common mistakes parents make in custody cases?
I've seen the same handful of mistakes derail otherwise strong cases, and almost none of them are about the facts of the case itself. They're about how parents handle themselves along the way.
- Venting on social media. Anything posted can end up in front of a judge, and it rarely helps the way people think it will.
- Badmouthing the other parent in front of the child. Courts pay close attention to whether a parent supports the child's relationship with the other side.
- Skipping documentation. Memory fades, and "I'll just remember it" doesn't hold up as well as a dated text thread.
- Letting emotion drive decisions. Fighting over something out of frustration, rather than what actually benefits your child, tends to show in how a judge perceives your priorities.
- Waiting too long to get legal guidance. Small missteps early on can be harder to undo later than people expect.
