What’s the difference between equitable and equal distribution?
This is one of the most common misconceptions in divorce.
Equal distribution means a strict 50/50 split.
Equitable distribution—which is what North Carolina uses—means a division that is fair, even if it’s not perfectly equal.
The court starts with the assumption that a 50/50 split is fair, but it can adjust that based on factors like:
- Income and earning capacity of each spouse
- Length of the marriage
- Contributions to the marriage (including as a stay-at-home parent)
- Health, age, and financial needs
- Any marital misconduct that affects finances
So while many cases do end up close to equal, the law allows flexibility to reach a result that actually makes sense for both parties’ futures—not just a clean mathematical split.
